Temu, the Chinese online e-commerce giant, was faced with a fine of EUR 200 million, as the European authorities considered that it did not take sufficient measures to prevent the placing of illegal products on the European Union market.
The decision was announced in Brussels on Thursday, following the first part of a wide investigation.
Further sanctions may follow in the coming months, in the context of almost two-year investigation under Digital Services Act, requiring major online companies to step up efforts against illegal and harmful content on their platforms.
The investigation began following complaints from the EU consumer organisation BEUC along with 17 national members. The European Commission stated that the company did not identify, analyse and carefully assess systemic risks from the sale of illegal products and the consequent harm to consumers in the EU.
The Commission also criticised Temu for not sufficiently assessing how the recommendations and product promotion programmes from cooperating influencers could increase the risks of the disposal of illegal products.
The company said it respects Digital Services Act goals and the need for clear and consistent rules in the digital economy, but disagrees with the decision and considers the fine disproportionate. According to Temu, the decision concerns its first DSA assessment in 2024 and does not reflect the current state of its systems.
Temu argued that it worked constructively with the European Commission throughout the process and that in the meantime it has taken additional measures to enhance risk assessment, platform governance and user protection. The company also said it would continue the dialogue with regulatory authorities and examine all its options.

Σύμφωνα με την ίδια, η έρευνα θα συνεχιστεί για να εξεταστεί αν ο σχεδιασμός της υπηρεσίας είναι εθιστικός, καθώς και μια ευρύτερη αξιολόγηση για το αν διατίθενται παράνομα προϊόντα και για την πρόσβαση σε δεδομένα που σχετίζονται με τα συστήματα συστάσεων και τους ερευνητές.
Για παραβιάσεις του Digital Services Act, οι εταιρείες μπορεί να αντιμετωπίσουν πρόστιμα έως και 6% του παγκόσμιου ετήσιου τζίρου τους.
Η κύρωση προς την Temu είναι η δεύτερη που επιβάλλεται στο πλαίσιο του κανονισμού, μετά το πρόστιμο ύψους 120 εκατ. ευρώ που είχε επιβληθεί τον Δεκέμβριο στο κοινωνικό δίκτυο X του Elon Musk. Με την προθεσμία για το σχέδιο δράσης να πλησιάζει, το επόμενο διάστημα θα κρίνει αν τα μέτρα συμμόρφωσης της Temu θεωρούνται επαρκή και αν θα υπάρξουν πρόσθετες συνέπειες.
