Consumers pointed out, however, that Nike increased prices on certain footwear by $5 to 10 and on certain garments by $2 to 10 in order to offset costs.

«Nike has made no legally binding commitment to repay overcharges related to customs duties to consumers who paid them», reported the complaint.

«Unless limited by this court, Nike is entitled to recover the same duty payments twice – once by consumers through higher prices and again by the federal government through duty refunds».

Thus Nike was found on the same list as other companies, including Costco and EssilorLuxottia's Ray-Ban sunglasses manufacturer, who have been sued by consumers for allegedly not passing the duty refunds on consumers.

As Reuters reports, the lawsuit against Nike was filed at the Portland, Oregon federal court.

On a teleconference on 31 March, Nike also stated that the financial quarter ending in August 2026 would likely be the last quarter in which customs duties would constitute a significant obstacle to the gross profit margin on an annual basis.
