The non-identification of the National Land Register Code (CAEC) with the registered owner is one of the issues that arise when completing the Single Aid Application (EGE) 2026, particularly in cases where the data of the declared area does not comply with those shown in the Land Register.

This issue was the subject of communication from the Agricultural Press with geotechnical experts involved in the submission of IACC declarations, with the interest of focusing on the possibility of documenting the discrepancies and their possible impact on the course of aid.

The framework for dealing with these cases is reflected in the recent responses of the Independent Public Revenue Authority (ADE), which cover the envisaged grounds for exemption, supporting documents and the payment process.

How non-identification is addressed

According to the clarifications of AADE, when a parcel is declared as owned and a warning or error occurs that the CAEC does not correspond to the registered owner, the producer must document the reason why it does not appear as owner. For this purpose the choice of the appropriate reason for exemption from the relevant list of myAGRO application is provided.

The submission body shall be provided with the documents documenting the particular reason or, as a minimum, a relevant declaration by the producer via gov.gr or with a view to the authenticity of the signature. The declaration shall specify the reason for the exemption and indicate that the relevant documents are kept in the producer's file and are available in case of verification. Where there is no legal reason for exemption, no CAEC may be registered which is not confirmed by the Land Register.

As Geotechnicalians who are involved in the submission of declarations point out, the emergence of an incompatibility does not necessarily mean that the parcel cannot be included in the application. The crucial element is to examine whether any of the exceptions provided for exist and whether the producer can document it with the appropriate supporting documents.

Which cases are included in the exceptions

The 17 envisaged options include, inter alia, cases of purchase of property, heritage, donation or parental provision, profit, exchange, sub-housing and inheritance society.

In addition, cases of non-conclusion of reforestation, cadastral treatment, objection to the Real Estate Register, claim of property through use, as well as properties that appear as an unknown owner or have not been declared in the Real Estate Register by their owner.

A separate option is provided for the use of a parcel with a public KEK displayed, while the list includes other special cases, such as the sale after 31 May 2026 and the different imprint on the residential record.

For the specificity of the supporting documents by category of exemption, the ADE has indicated that a decision will be taken. Therefore, the choice of a reason for exemption does not in itself imply the definitive acceptance of the stated elements.

What the model responsible declaration provides for

ADE has made publicly available a model responsible declaration for cases of objective inability to identify the declared area with a valid ATAK and/or KAU at the time of submission of the EAU. According to the model, the producer states that the information in his application concerning the parcels for which there is an objective inability to identify is true, accurate and complete. At the same time, it states that it has the legal and appropriate supporting documents, which give rise to the grounds for exemption and the inability to identify.

Such documents may include, where appropriate, notarial acts, private contracts, inheritance acceptance acts, leases or concessions of use, cadastral or judicial documents and administrative acts.

The responsible statement shall be submitted to the authorised submission body of the EAE and shall form part of the documentation file kept by the body. At the same time, the producer undertakes to keep the relevant supporting documents in his file and display them or send them to the competent authorities whenever requested. In addition, in the event of the removal or completion of the relevant procedure, it shall declare that it will register the correct elements of ATAK and/or KAEC in accordance with the applicable framework and instructions of the competent authority.

According to Geotechnicals, the possibility of making a responsible declaration is a practical outlet for cases where identification cannot be completed at the time of submission of the EAE. They point out, however, that this procedure does not replace the need to substantiate the reason for exemption, as the producer is still required to have the relevant supporting documents for possible verification.

What is foreseen for payments

Of particular interest is the clarification of the ADE concerning the parcels for which one of the intended reasons for not identifying CEC is stated. According to the official replies, these parcels are included in the payment of the advance and in the first payment in December, following the other checks required for the payment of the aid.

This provision does not mean automatic approval or payment of the aid. ADE will verify the accuracy of the stated reasons for non-identification and will take the necessary actions in accordance with the current institutional framework.

From the point of view of geotechnicals, this provision is of particular practical importance, as the existence of a reasoned disagreement with the CAEC does not in itself imply the exclusion of the parcel from the payment procedure. They stress, however, that inclusion in payments presupposes that the remaining checks are carried out, while the declared grounds for exemption are also subject to scrutiny.

Therefore, the correct choice of the reason for exemption and the availability of the relevant supporting documents remains to be confirmed so that the data can be verified in a possible audit.
